Aggressive IRS Enforcement Takes Toll on Taxpayer Advocates Tax Relief Services



A decline in funding, coupled with swelling numbers of taxpayers seeking tax help, has left the National Taxpayer Advocate Service unable to assist many taxpayers in need of relief from IRS back taxes and other collection-related issues

Encino, CA, October 27, 2010 -- Faced with a historic deficit, the federal government has taken an aggressive stance on tax collection. And according to a recent report, the National Taxpayer Advocate Service (NTAS), the government office created to help protect the rights of U.S. taxpayers and advocate on their behalf, has been unable to keep up with rising case numbers due to ramped up IRS collection efforts.

In 1998, as part of the Taxpayer Bill of Rights, Congress created the National Taxpayer Advocate Service (NTAS) to provide taxpayers with an independent ally to help them resolve tax problems they were unable to accomplish through normal IRS channels. The NTAS was empowered to go to provide tax relief to its clients, and could suspend pending IRS collection action, until a taxpayer’s issue was fully reviewed. The NTAS could even issue a Taxpayer Assistance Order (TAO) if the taxpayer would suffer a significant hardship due to the intrusiveness of IRS collection tactics.

However, Taxpayer Advocate Nina E. Olson recently noted in a report to the Treasury Inspector General that it was increasingly difficult for the NTAS to handle taxpayer cases in a timely manner. Even as the economic downturn has sent a surge of troubled taxpayers to the advocacy service, the Taxpayer Advocate has seen its budget decline and its resources dwindle. After answering a high of 87 percent of its calls in 2004, it answered only 53 percent of calls in 2008, and expects to do only slightly better this year.
